Terms of Use

Welcome to Bossa Companion (the “Platform”, “Bossa Companion”, “we”, “our” or “us”). These terms of use (“Terms”) govern access to and use of the Platform and form a contract between you (“User” or “you”) and Bossa Companion.

The Platform is an online service that uses artificial intelligence (“AI”) to create fictional virtual characters (the “AI Companions”) with whom you can hold text conversations and, where applicable, generate images or other content (the “Services”). All AI Companions are fiction. They do not represent real people and do not exist outside the system.

By creating an account, accepting these Terms or continuing to use the Platform, you declare that you have read, understood and fully accepted these Terms, as well as the Privacy Policy, the Age Verification Policy, the Minors Policy, the Prohibited Content and Removal Policy and the Cookie Policy, all of which are an integral part of these Terms.

1. Account and registration

1.1 Creating an account

Access to the Platform requires registering a personal account (the “Account”) with an email address and a password. In creating your Account, you represent and warrant that:

• All information provided is true, accurate and current;
• You are entitled and authorised to provide that information;
• You are 18 years of age or older and have full legal capacity to contract with us.

1.2 Account holder obligations

You undertake to:

• Keep your Account data up to date (email, payment details and so on);
• Keep your access credentials confidential;
• Take full responsibility for all activity carried out under your Account, including by third parties who access it with your knowledge or through your negligence.

The Account is personal and non-transferable. Selling, assigning, renting or sharing your Account with third parties is prohibited on any pretext.

1.3 Suspension and termination

Breach of these Terms, including keeping inaccurate information or misusing the Platform, may result in suspension or termination of the Account, at our sole discretion, with or without prior notice, without prejudice to any other applicable legal remedies. Without prejudice to other remedies available, the conduct listed in Section 5 below leads to immediate termination of the Account.

2. Mandatory age verification

In compliance with Law No. 15,211/2025 (the Digital ECA) and Decree No. 12,880/2026, Bossa Companion uses a reliable age verification mechanism, which will be in force as long as the Platform offers content or functionality prohibited to people under 18.

Verification is carried out through an independent specialist provider, which analyses an official document and performs biometrics with liveness detection. We will not store the image of your document or of your selfie. We receive only the binary confirmation (over or under 18), which is the only datum retained for audit purposes.

3. Subscriptions, tokens and payments

3.1 Billing model

The Platform offers a free tier and paid subscription plans with automatic monthly or annual renewal. In addition, specific features (such as image generation) may require the use of tokens, bought in standalone packs or included in certain plans. The number of credits included in each plan, the price of each plan and the price of each standalone pack are those stated on the subscription page at the time of purchase.

The 7-day pass is a one-time purchase with no automatic renewal, paid by Pix only and available only to accounts with verified age. The pass messages and tokens are valid for 7 (seven) days from payment confirmation and expire at the end of that period. Buying another pass while the previous one is valid adds the balances and restarts the 7 days from the new purchase. The pass balance is used before any other balance on the account. The right of withdrawal in section 3.4 is preserved.

3.2 Payment methods

Payments are processed by an authorised partner and may include credit card, Pix or other methods available at the time of purchase. Bossa Companion does not store card data in its own systems. At the time of purchase, the data is sent over an encrypted connection to the processor, which performs the capture.

3.3 Renewal and cancellation

Subscriptions renew automatically at the end of each cycle unless cancelled by the User before the renewal date. You can cancel at any time under Profile → Subscription, and keep paid access until the end of the current period.

3.4 Refunds

In accordance with Art. 49 of the Brazilian Consumer Protection Code (Law No. 8,078/1990), you may withdraw within 7 (seven) calendar days of payment, with a full refund.

After that period, cancellation, the criteria used to assess each request, reversal timelines and how the charge appears on your statement are set out in the Refund and Cancellation Policy, which forms part of these Terms.

Tokens are personal, non-transferable and non-refundable once consumed. Chargebacks or unjustified disputes may lead to suspension of the Account.

4. Intellectual property

4.1 Ownership

All intellectual property rights in the Platform, its software, algorithms, models, texts, images, trademarks, layouts and other materials (the “Content”) belong to Bossa Companion or its licensors, as protected by applicable law.

4.2 Licence of use

We grant you a personal, limited, non-exclusive, revocable and non-transferable licence to access and use the Platform, for personal and non-commercial use only. It is prohibited to:

• Reproduce, distribute, modify or create derivative works from the Content;
• Reverse engineer, decompile or disassemble the Platform;
• Remove intellectual property notices;
• Use the Platform to train competing AI systems.

4.3 Images generated for you

Images generated on the Platform are our Content, licensed to you for strictly personal and private use. You may not publish, forward, resell, share on social networks, forums, messaging groups or any other channel, nor otherwise make available to third parties, the images you received.

Every delivered image carries an individual, encrypted identification mark embedded in the file itself. The mark allows Bossa Companion to identify which Account that copy was delivered to, should it appear outside the Platform. The mark is not readable by third parties and does not disclose your identity to anyone who receives the file.

Unauthorised distribution of images breaches these Terms and may lead, at our discretion, to suspension or permanent termination of the Account, without refund, in addition to any available civil and criminal remedies. Removing, altering or attempting to remove the identification mark is a separate breach of these Terms, with the same consequences.

This clause does not restrict your rights as a data subject, which are addressed in the Privacy Policy.

4.4 User Content

You retain ownership of the texts, prompts and other materials you submit (“User Content”). By submitting them, you grant Bossa Companion a worldwide, non-exclusive, royalty-free, sublicensable licence limited to what is necessary to operate and improve the Platform, within the limits of the Privacy Policy and the LGPD.

4.5 Characters you create

You can create a Character by choosing her looks, personality and preferences from the Platform's options and giving her a name. A created Character is still fiction generated by artificial intelligence: she is always an adult woman, over 18, unrelated to any real person, and her images and texts are produced by the Platform.

• The Character you create is yours only: she does not appear in the showcase or to other Users.
• The name and any text you write go through automated moderation. Trying to create a Character with the appearance or role of a minor, or based on a real person, is refused and, if repeated, may block creation and lead to suspension of the Account.
• Each creation uses one creation credit, included every month in paid plans or bought separately. New accounts get one free credit. If a creation fails because of an error on our side, the credit is returned. Giving up in the middle of a creation returns the credit once per day.
• You can delete the Character at any time, and with her the conversations and photos of her in your Account.

5. Conduct and restrictions

It is prohibited to use the Platform to:

• request, induce, generate or attempt to obtain material that sexualises a child or an adolescent, or a person of ambiguous apparent age, including where the request is made by euphemism, by staged escalation or by splitting it across separate steps;
• attempt to defeat age verification, including through a forged document, a third party's document, or the use of a photograph, mask or recording to deceive liveness detection, or acquiring an Account already verified by someone else;
• generate or attempt to generate sexual content depicting an identifiable real person, including a public figure, whether by deepfake, impersonation or use of that person's name or likeness;
• produce material intended for extortion, sextortion, revenge or the stalking of an identified person;
• engage in any conduct falling within the strictly prohibited categories of the Prohibited Content and Removal Policy;
• commit any payment fraud, including use of a third party's payment instrument without authorisation, card testing, or use of data obtained unlawfully; and/or
• carry out any intrusion, unauthorised vulnerability scanning, or an attack on the availability or integrity of the systems.

6. Moderation and responsibility for content

AI Companions generate replies based on the Platform parameters and on your inputs. You are solely responsible for the User Content and for any material you induce the AI to produce. We reserve the right to review, moderate, filter, remove or block content that breaches these Terms, our policies or applicable law.

We apply moderation in multiple layers, involving prior filtering, automated post-generation review and specialised human review. Serious violations may be reported to the competent authorities.

7. Disclaimer of warranties

The Platform is provided “as is” and “as available”. We do not warrant that the Platform will be uninterrupted, error-free or secure, or that the results generated will be accurate, appropriate or fit for any particular purpose.

AI replies do not constitute medical, legal, financial, psychological or professional advice of any kind. They must not be used as a substitute for guidance from qualified professionals.

8. Limitation of liability

To the fullest extent permitted by Brazilian law, Bossa Companion is not liable for indirect damages, loss of profits, loss of data or reputational harm arising from use of the Platform.

9. Personal data and privacy

The processing of personal data is governed by Law No. 13,709/2018 (LGPD) and detailed in our Privacy Policy. You hold the rights of access, correction, deletion, portability and objection set out in the LGPD.

10. Changes to these Terms

We may change these Terms at any time. Material changes will be communicated by email or by notification in the Platform at least 10 (ten) days before they take effect. Continued use of the Platform after the new version implies tacit acceptance.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the City of Rio de Janeiro, State of Rio de Janeiro, are elected to settle disputes, with express waiver of any other, however privileged, save for the consumer's right to bring proceedings in their own domicile under Art. 101, I of the Consumer Protection Code.
